Help please - breach of copyright

Someone has 'stolen' 160 of my photos from here and posted them on their website claiming them to be theirs. I have emailed them reminding them that the photos are not theirs and they are in breach of copyright, but they continue to ignore me.

What can I do next to remove my photos from their website, considering that they just ignore everything I send them?

Thanks - but I'm not really sure how I can go about getting my photos removed from their website when they keep on ignoring my emails.

Give us the link and I should be able to give you the hosting information to get their website yanked off the servers if they refuse to take the photos down. Legal threat= low tolerance. Save all your emails asking them to take down your photos.

One of our dutch users will have to help you more . I can't get the dutch registry look up http://www.domain-registry.nl/whois.php to work for me. But try http://www.isd-holland.nl/ and emailing the addresses on there or using a translator page to view the information.

You might want to beef up the "Copyright Statement for Images" field on PBase. Go to your profile page and click on "edit your account settings". I've put the following in that field:

Copyright © 2002-2003, John Saalwaechter. All Rights Reserved. Usage/copying without express permission is prohibited.

Not that this is going to stop someone who will blatantly violate copyright, but at least there's no question about your stance.

Use ampersand-"copy"-semicolon to generate ©

ISD have now removed the offending site and disabled the users account.

Many thanks to you all for your help.

A big thanks for Srijith for posting the information. The byte gods were not smiling on me to get on to their site.

The moral of the story is always give them the option to take down the images, if they won't then complain to their hosting and have their account killed.Almost every hosting company out there will take action. Its cheaper to lose that one account then answer a summons to court about it.

Glad it worked out for you.
Bill

Yes, someone else found them and told me about it.

One for the good guys! Well done. I too was sent an email from a kind individual who advised me that someone was passing off my images, as well as other PBasers such as Karen Nichols, as his own on a Hong Kong site. The site removed his images (after receiving a call from my lawyer!). But I have no idea how the person who advised me in the first place knew they were my images as I did not know that person. I post a lot on Fred Miranda so I assume that someone recognised my images. We are apparently getting a close knit group of photographers, pro and amateur and are happy to "dob" in some unscrupulous folk. But it will only be a matter of time before your images (and mine) will appear elsewhere so I guess we will have to live with it. Even posting very low res images doesn't help and I don't really want to resort to posting HUGE watermarks on images but it may come to that eventually.

Cheers
Sheila
